DriverPeak Terms of Service

1. Agreement
By creating an account or using DriverPeak, you agree to these Terms of Service ("Terms"). If you don't agree, don't use the service.
2. The service
DriverPeak provides tools for uploading, analyzing, and comparing motorsports telemetry data from supported logging hardware and simulators. Features and supported formats may change over time.
3. Accounts
You're responsible for maintaining the security of your account and password. You must provide accurate information when creating an account. You're responsible for all activity that occurs under your account, including uploads made via the desktop sync agent using your device token.
4. Your content
You own your data. Telemetry files, session data, and any content you upload remain yours. By uploading content, you grant DriverPeak a license to store, process, and display that content solely to provide the service to you and, where applicable, to team members you've shared it with.
You're responsible for what you upload. You confirm you have the right to upload the telemetry data you provide (e.g. it's your own driving data, or you have permission to upload data on behalf of a team you're authorized to represent).
5. Teams and shared data
Creating or joining a team means your sessions may become visible to other members of that team, according to the team's configuration and roles. You control which team(s) you belong to. Team admins can invite new members via invite links; accepting an invite is your explicit consent to share your session data with that team.
6. Acceptable use
You agree not to:
- Upload data that isn't yours or that you don't have rights to share
- Attempt to access another user's or team's data without authorization
- Use the service to violate any law or the rights of others
- Attempt to circumvent rate limits, security measures, or other technical protections
- Use automated means to access the service outside of the officially provided desktop sync agent
7. Subscriptions and billing
This section needs to be completed once billing is actually built — pricing tiers, billing cycle, cancellation policy, refund policy, and what happens to data/access if a subscription lapses should all be specified explicitly and reviewed by counsel before this goes live. Do not publish this section as a placeholder.8. Free tier and usage limits
DriverPeak may offer a free tier with usage limits (e.g. number of sessions per month) and may change these limits with notice.
9. Service availability
We aim to keep DriverPeak available and reliable, but we don't guarantee uninterrupted access. We may perform maintenance, and features may change or be discontinued with reasonable notice where practical.
10. Termination
You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or pose a security risk to the service or other users.
11. Disclaimers
DriverPeak provides telemetry analysis, including automated lap detection, as a tool to assist your own judgment — not as a substitute for it. Lap detection and analysis results include a confidence indicator specifically because automated detection can be uncertain; you're responsible for how you interpret and act on this information, including any decisions related to vehicle setup, driving technique, or safety.
